1. Introduction

These Terms of Service govern your access to and use of the Ezy Travels platform, including our website, mobile applications, and related services.

Ezy Travels is a service operated by AGENCEE Travels Inc., located at Dede Awula Street, Adabraka, Accra, Ghana.

By accessing or using the Services, you agree to be legally bound by these Terms.

2. Platform Status

Ezy Travels operates solely as a digital booking and facilitation platform that connects users with independent transport operators and other third party service providers.

Ezy Travels does not own, control, operate, or manage any transport services. We are not a carrier, transport provider, travel operator, or insurer.

All transport services, schedules, fares, availability, safety standards, and service delivery are the sole responsibility of the relevant third party provider.

Your contract for transport services is directly between you and the transport provider.

3. Eligibility

You must be at least eighteen years old to create an account and use the Services.

If you make a booking on behalf of another person, you confirm that you have authority to do so and that all information provided is accurate.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

Any booking made through your account is deemed authorised by you unless you notify us promptly of unauthorised access.

We may suspend or terminate accounts where there is suspected fraud, misuse, payment irregularity, or legal risk.

5. Bookings and Payments

A booking is not confirmed until payment has been successfully received and verified.

Ezy Travels is not responsible for bank errors, payment gateway failures, or payment reversals beyond our reasonable control.

If a payment is reversed, disputed, or reasonably suspected to be fraudulent, we may cancel the booking without liability.

6. Refunds and Cancellations

Refunds relating to third party transport services are strictly subject to the transport provider’s cancellation and refund policy.

Ezy Travels is not required to issue any refund unless and until the corresponding funds are received from the third party provider.

Service or processing fees charged by Ezy Travels may be non refundable.

7. User Responsibilities

You agree to:

  1. Provide accurate and complete information.
  2. Comply with all applicable laws and transport provider requirements.
  3. Arrive at departure points on time.
  4. Ensure compliance with identification, health, and travel regulations.

Ezy Travels is not liable where boarding is denied due to user non compliance.

8. Third Party Services

Transport operators, payment providers, and other third parties are independent entities.

Ezy Travels does not guarantee their performance and shall not be liable for delays, cancellations, accidents, injuries, baggage loss, or service failures caused by such third parties.

9. Disclaimer

The Services are provided on an as available basis.

Ezy Travels makes no warranties regarding availability, accuracy of third party information, uninterrupted access, or suitability for a particular purpose.

Users assume all risks associated with travel.

10. Limitation of Liability

To the fullest extent permitted by Ghana law, Ezy Travels’ total liability arising out of or relating to the Services shall not exceed the total amount actually paid by you to Ezy Travels for the specific booking giving rise to the claim.

Ezy Travels shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, missed connections, loss of business, or reputational harm.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, gross negligence, or death or personal injury caused by negligence.

11. Claims Procedure

Any claim arising from the Services must be submitted in writing within thirty days of the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold harmless Ezy Travels and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:

Your breach of these Terms.

Fraudulent activity or payment disputes.

Inaccurate information provided by you.

Your violation of law or third party rights.

Misuse of the platform.

This obligation survives termination.

13. Suspension and Termination

We may suspend or terminate access immediately where reasonably necessary to prevent fraud, manage security risks, comply with law, or protect the business or other users.

14. Force Majeure

Ezy Travels shall not be liable for delays or failures caused by events beyond our reasonable control, including severe weather, strikes, civil unrest, government directives, transport disruptions, epidemics, power failures, or technology outages.

15. Dispute Resolution

If a dispute arises, parties shall first attempt informal resolution.

If unresolved, the dispute shall be finally resolved by arbitration in Accra, Ghana under the rules of the Ghana Arbitration Centre.

Disputes must be brought on an individual basis and not as part of a class action.

16. Privacy

Your use of the Services is subject to our Privacy Policy, which forms part of these Terms.

17. Governing Law

These Terms are governed by the laws of the Republic of Ghana.

18. Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Ezy Travels.

If any provision is unenforceable, the remaining provisions remain in effect.
